Shop Seller Terms
Last updated November 5, 2026
These terms apply when a business sells on the FoilFox marketplace. In them, “the shop”, “you” and “your” mean the business, and “FoilFox”, “we” and “us” mean Old Blue Chair LLC, the Texas company that owns and runs FoilFox. Everything in the FoilFox Seller Terms applies to you as well, except where these terms say otherwise. A shop agrees to both, and where they disagree, these terms apply to shops.
A1. Who can sell as a shop
1.1 To sell as a shop you must be a business registered in the United States, such as a company, LLC, partnership or sole proprietorship, with:
- a US bank account in the business's name;
- the tax details Stripe asks for, such as an EIN, or for a sole proprietor an SSN;
- a representative who is 18 or older and has authority to bind the business. The representative agrees to these terms for the business and completes Stripe's business verification.
This replaces section 1.1 of the Seller Terms for shops.
1.2 People who act for the shop, such as owners and staff with access to the shop's FoilFox workspace, act on the shop's behalf. The shop is responsible for everything they do on FoilFox. Keep the list of people with access up to date, and remove access when someone leaves.
1.3 Stripe holds your business, tax and bank details. FoilFox never sees your full bank account or tax number.
A2. Approval and standards
2.1 Approval. FoilFox reviews every shop before its stock can be bought. We may ask for more information, and we may decline a shop without giving a reason. Your stock becomes buyable only when all of these are true:
- your shop is approved;
- your payout setup with Stripe is complete;
- nothing has paused your selling.
2.2 Standards. We expect a shop to:
- ship on time (section A6);
- describe condition accurately (Seller Terms section 6);
- fill what it sells (section A4).
The strikes in Seller Terms section 12 apply to shops. Lines a shop couldn't fill are counted by their rate instead of as strikes toward the three: a shop's selling pauses when, in any 90 days, it has 3 or more cancelled lines and they make up 2% or more of the lines it sold.
2.3 A pause works as in Seller Terms section 12.3:
- your offers stop being buyable;
- orders already paid still ship and pay out;
- a person at FoilFox reviews the shop before selling resumes.
A3. Your listings
3.1 You list cards from your own stock. Each offer is for an exact catalog version, finish and language, with a condition, a price and a quantity.
3.2 Shop offers may show the catalog picture of the version instead of a photo of your copy. The catalog picture shows which card it is, not your copy's condition. Your condition, chosen from FoilFox's condition guide, is what you promise the buyer. This replaces section 5.1 of the Seller Terms for shops.
3.3 You must have every card you list in hand, ready to ship within your handling time.
A4. Keeping stock accurate, and lines you can't fill
4.1 If you also sell the same cards elsewhere, such as in your store, on your own site or on other marketplaces, keep your FoilFox quantities in step. Use FoilFox's stock tools or a connection FoilFox supports. A FoilFox order counts against your stock from the moment the buyer pays.
4.2 If you can't fill a line of a paid order, mark it “Can't fill” as soon as you know:
- the buyer is refunded that line in full at once: the card, its sales tax, and the package's shipping when nothing is left to ship;
- your stock for that line goes to zero;
- it counts as a cancelled line (section A2.2).
4.3 You pay the cost of a line you can't fill. FoilFox's fee isn't charged on it. The card processing on it, which Stripe keeps, comes out of your next transfer.
A5. Condition
5.1 The condition guide in Seller Terms section 6 applies to every card you sell. A shop's own grading scale doesn't replace it. If your scale uses other names, map each card to FoilFox's guide, and when unsure choose the lower condition.
A6. Shipping
6.1 Handling time. You set a handling time of 1, 2 or 3 business days. Buyers see it before they pay. An order not shipped by the end of your handling time cancels itself, as Seller Terms section 7.1 describes. This replaces the fixed 3 days of section 7.1 for shops.
6.2 Your shipping rates. This replaces section 7.4 for shops.
- You set a flat shipping charge per order, up to $25, and you may offer free shipping from an order value you choose. Buyers see your rates before they pay, as a separate shipping line for your package.
- Until you set rates, FoilFox's standard rates apply: $1.50 untracked under $20 of cards, $7.50 tracked from $20.
- Whatever your rates, orders of $20 or more in cards must ship with tracking, and orders of $250 or more with signature confirmation.
6.3 Cards from $250. An approved shop ships these directly to the buyer, with tracking and signature confirmation. Verified by FoilFox (Seller Terms section 8) doesn't apply to shop orders.
6.4 Packing. Pack every card as Seller Terms section 7.3 describes. Include FoilFox's packing slip or your own, with the FoilFox order number. Don't include anything that invites the buyer to buy from you outside FoilFox (section A9).
6.5 Labels. You may buy labels through FoilFox, at FoilFox's rates, with the postage taken from that order's transfer. Or you may use your own labels and enter the tracking number.
A7. Fees, transfers and payouts
7.1 Fees. Shops pay the same fees as every seller (Seller Terms section 3):
- 6% of the cards' price;
- card processing at 2.9% + 30¢ per order, on the cards and the shipping.
There is no listing fee and no monthly fee.
7.2 When you're paid.
- An order's money is released as Seller Terms section 2.4 describes. For shop orders shipped straight to the buyer, release comes 3 days after tracking shows delivery, or 14 days after you ship if there is no delivery update.
- The released money is then transferred to your Stripe balance and paid out on the Monday schedule in section 2.5.
- While your shop is new, FoilFox may set limits on order size and payout timing, and tells you what they are in your workspace. We lift them as your record builds.
7.3 Money we take back. Seller Terms section 2.6 applies, along with:
- label postage you bought through FoilFox;
- the processing on lines you couldn't fill (section A4.3);
- the dispute fee in Seller Terms section 11.
7.4 Closing. When a shop closes or is closed:
- open orders finish under these terms;
- we pay out what you've earned;
- we may hold money for up to 120 days after your last order is released, to cover claims, returns and chargebacks (Seller Terms section 2.7).
A8. Taxes
8.1 Seller Terms section 2.9 applies: FoilFox calculates, collects and pays sales tax on marketplace sales in the states where the law makes it responsible. Don't charge buyers sales tax on FoilFox orders.
8.2 FoilFox files Form 1099-K for your shop where the law requires it, through Stripe, as Seller Terms section 2.8 describes.
A9. Buyers' information and selling outside FoilFox
9.1 You get a buyer's name and address only to ship their order. Don't use them for anything else, including marketing, mailing lists or other sales. Delete them from your own systems once the order's return and claim window has closed.
9.2 Don't offer or complete a sale outside FoilFox with a buyer you met through FoilFox, and don't put anything in a package that invites one, such as discount codes for your own site.
A10. Your shop's public profile
10.1 Buyers see your shop's name and state on your offers, with your record: sales, ratings and shipping times. Keep them accurate.
10.2 The INFORM Consumers Act section of the Seller Terms (section 14) applies to shops. If your shop becomes a high-volume seller, FoilFox verifies the information the Act requires and shows buyers what it requires us to show.
A11. Counterfeits, prohibited items and rights notices
11.1 Seller Terms sections 4, 9.6 and 17 apply to shops in full. A shop that sells a counterfeit:
- refunds the buyer;
- loses the card;
- may have its selling ended.
FoilFox keeps a record of reports against the shop.
A12. Ending
12.1 You can stop selling at any time by removing your offers or asking us to close your shop. Open orders still ship.
12.2 We may pause or end a shop's selling under Seller Terms section 12.4, or if the shop stops meeting section A1. We tell you why, unless the law or a fraud investigation prevents it.
