FoilFox
Seller Terms
Last updated October 30, 2026
These terms are an agreement between you and Old Blue Chair LLC, the Texas company that owns and runs FoilFox (“FoilFox”, “we”, “us”). They apply whenever you list or sell cards to other collectors on the FoilFox marketplace.
They sit alongside the FoilFox Terms of Service and Privacy Policy. If those documents and these terms disagree about selling, these terms apply. The FoilFox Buyer Protection and Returns Policy is part of these terms: it sets out what your buyers are promised, and by selling you agree to it as well.
1. Who can sell
1.1 To sell on FoilFox you must:
- be 18 or older. You confirm this once in the app. If the identity check during payout setup shows you are under 18, or that a parent or guardian is opening the account for you, you can't sell;
- live in the United States and sell as an individual, in your own name;
- have a US bank account in your own name;
- finish payout setup with Stripe, our payment processor. Stripe checks your identity and collects your bank and tax details. FoilFox never sees your full bank or Social Security number.
1.2 One seller account per person. Don't sell on someone else's behalf, and don't let anyone else use your account.
1.3 Keep your details up to date: name, address, phone, email, bank and tax details.
1.4 We may decline to open selling for anyone, and we may ask for more information before we do.
2. How you get paid
2.1 Stripe. Payments and payouts on FoilFox are handled by Stripe. When you set up payouts, you accept the Stripe Connected Account Agreement, which includes the Stripe Services Agreement, as Stripe updates them from time to time. You allow FoilFox to share your information and your sales with Stripe, and to tell Stripe when to pay you out.
2.2 FoilFox collects payment for you. You appoint FoilFox as your agent for one limited purpose: to receive buyers' payments for your cards through Stripe and to pay them on to you under these terms.
- A buyer's payment counts as paid to you as soon as it reaches FoilFox's payment processor. From that moment the buyer owes you nothing more for that order, even if a payout to you is later delayed or fails.
- FoilFox tells buyers at checkout that it collects payment on your behalf.
- Apart from collecting payment, FoilFox is not your agent, and you are not FoilFox's employee, partner or agent.
2.3 Where the money is. When a buyer pays, your share (the card price and shipping, less the fees in section 3) goes into your Stripe balance. Stripe holds it, not FoilFox, and it isn't a bank deposit. It is paid to your bank only when FoilFox tells Stripe to, under the rules below.
2.4 When an order's money is released. An order's money is released to you at the first of these:
- Orders sent straight to the buyer:
- the buyer's arrival scan matches and they tap All good;
- 24 hours after the buyer's arrival scan matches;
- 3 days after tracking shows delivery, or, if FoilFox has no delivery update, 14 days after you ship.
- Verified orders (section 8): when FoilFox's check passes.
An open claim, a return in progress, a card-network dispute (chargeback) or an arrival scan that shows a different card holds the release until it's settled.
2.5 Payouts.
- We pay out every Monday, once your released money reaches at least $25. Below that, it waits for the next Monday it reaches $25.
- While you're a new seller (section 12), money becomes payable 3 days after it's released.
- An order with any refund on it is paid out after a person at FoilFox has checked its numbers.
- Your bank usually shows a payout within 1 to 2 business days after we send it.
- If a payout fails (for example, a closed bank account), Stripe asks you to update your bank details. We send the payout again once they're fixed.
2.6 Money we can take back. We may recover the following from your unreleased money, your released money, or your next payouts:
- refunds decided under these terms and the Buyer Protection and Returns Policy;
- the return postage you pay on a refund (section 10);
- a chargeback FoilFox loses, but only when a claim on the same facts would have been decided against you (section 11);
- money paid to you by mistake.
If those don't cover it, your Stripe balance can go below zero. You authorize Stripe, on FoilFox's instructions, to debit the bank account linked to your payouts for the shortfall. Anything still unpaid is a debt you owe FoilFox, and we may pause your selling until it's paid.
2.7 When you stop selling or close your account. We pay out the money you've earned, on the normal Monday schedule and even if it's under $25. We may hold money from your sales for up to 120 days after your last order was released, to cover claims, returns and chargebacks that can still arrive. If a dispute or a fraud investigation is open, we may hold the money involved until it's settled, for no more than 180 days after your last order was released. If we can't pay you because your payout details don't work and you don't fix them, we deal with the money as the law on unclaimed property requires.
2.8 Tax forms. If your FoilFox sales reach the federal reporting threshold, or your state's lower one, FoilFox files a Form 1099-K for you and sends you a copy through Stripe. Your income tax is your responsibility, and FoilFox doesn't give tax advice.
2.9 Sales tax. In the states where the law makes FoilFox responsible for sales tax on marketplace sales, FoilFox calculates it, collects it from the buyer at checkout and pays it to the state. You don't collect sales tax on those FoilFox orders. Your own state may still require you to hold a sales tax permit; check with your state's tax agency.
3. Fees
3.1 FoilFox's fee is 6% of the cards' price on each order. There is no listing fee, and no FoilFox fee on shipping or sales tax.
3.2 Card processing is 2.9% + 30¢ per order, on the cards and the shipping, passed on at Stripe's standard rate.
3.3 What you keep on one card shipped tracked ($7.50 shipping):
| Card price | FoilFox fee (6%) | Card processing | You keep |
|---|---|---|---|
| $20.00 | $1.20 | $1.10 | $25.20 |
| $100.00 | $6.00 | $3.42 | $98.08 |
You pay your postage out of the shipping charge (section 7.4). The app shows what you'll keep before you list and on every order.
3.4 Buyers pay for Verified, never you.
3.5 Fees on refunds. When part or all of an order is refunded, the fees on the refunded part come back to you in proportion. The return postage in section 10 is still yours to pay.
3.6 Fee changes. We tell you in the app and by email at least 30 days before a fee goes up. A new fee applies only to orders paid after it takes effect.
4. What you can sell
4.1 You can sell single, ungraded trading cards that:
- match a printing in the FoilFox catalog;
- you own, have in hand, and can ship within 3 business days;
- are priced in US dollars, for buyers in the United States.
4.2 Limits:
- each card at least 25¢;
- each order at least $5 of cards from one seller;
- each order at most $1,000 of cards while the marketplace is in its pilot. We tell you in the app before this limit changes.
4.3 Not allowed:
- counterfeits, proxies, reprints passed off as originals, and fan-made or “custom” cards;
- cards altered to look like something they aren't (trimmed, re-backed, recolored, resurfaced or cleaned to hide wear);
- anything that doesn't match a catalog printing;
- code cards and other digital items, sealed product, and graded or slabbed cards;
- breaks, raffles, mystery packs, repacks, and anything else sold by chance;
- stolen cards, and cards you don't have yet (no presales);
- anything that is illegal to sell or to send by mail.
4.4 Fair play. Don't buy your own listings, bid up prices through another account, or try to avoid FoilFox's fees.
5. Listing your card
5.1 Every listing starts with a scan of your own card in the FoilFox app. The scan confirms the version, finish and language, and its photos become your listing photos. A catalog picture never stands in for your card.
5.2 You set the price and the condition (section 6). The app shows what you'll keep after fees before you list.
5.3 A listed copy is locked to its listing until it sells, you remove it, or the listing ends. You can't list the same copy twice.
5.4 Buyers can ask set questions about a card's condition. Answer with the set replies, and with a fresh photo when you're asked for one. Answer honestly: your answers are part of the listing.
5.5 We may hide or remove a listing that breaks these terms or that we can't confirm, and we tell you why in the app.
6. Condition
6.1 You choose the condition from FoilFox's condition guide:
| Condition | In plain words |
|---|---|
| Near Mint | Clean overall, with only minor imperfections. Not flawless and not a grade. |
| Lightly Played | Light wear you can see, on edges, corners or surface. Intact and fine to play sleeved. |
| Moderately Played | More visible wear, or several imperfections, but no serious structural damage. |
| Heavily Played | Heavy wear all over, which can include whitening, dents or creases. Still intact and recognizable. |
| Damaged | Serious or structural damage, such as tears, major creases, water damage, peeling, ink or alteration. |
Near Mint is the highest condition you can choose. The full guide, with examples, is in the app and at foilfoxtcg.com/conditions.
6.2 Show every defect you can see, such as whitening, scratches, creases, bends, print lines or a miscut, even when the condition you chose allows for it. If you're unsure between two conditions, choose the lower one.
6.3 FoilFox doesn't grade cards. Our conditions are not a PSA, BGS, CGC or other grade, and nothing on FoilFox predicts one. The scanner checks which card it is, not its condition.
6.4 Your listing photos and packing scan show the condition your card left you in. Take them in good light, and don't hide flaws with glare or angles.
7. Shipping
7.1 Ship within 3 business days of payment. Business days are Monday to Friday, and public holidays count as business days. If you haven't shipped by then, the order cancels itself, the buyer gets a full refund, and it counts as a late shipment (section 12). If you can't ship an order, it cancels the same way at the deadline.
7.2 Scan every card into the package with the app's packing scan. If the packing scan finds a different card, you can't mark the order shipped. You can ship without a packing scan, but it counts as a strike, and you lose the benefit of the doubt in a claim. A scan where the finish couldn't be read isn't held against you; a person looks at the photos.
7.3 Packing. Penny sleeve, then a toploader taped shut (tape the toploader, never the card), in a bubble mailer for tracked orders. A card saver or a sturdier box is a good idea for valuable cards. Claims for damage in transit look at how the card was packed.
7.4 Shipping charge and tracking. FoilFox sets the shipping the buyer pays, and you buy the postage from it:
- orders of $20 or more in cards, and every Verified order: $7.50, and you must ship with tracking;
- orders under $20 in cards: $1.50, sent as a stamped envelope without tracking (the buyer is told that a lost envelope isn't covered);
- orders of $250 or more in cards: ship with signature confirmation.
7.5 Insurance. Some tracked services include a small amount of loss insurance. Above that, the card is your risk until it's delivered, unless you buy more cover. If a card is lost or damaged in the mail, you can make a claim with the carrier yourself.
7.6 Verified orders go to FoilFox's hub, not the buyer. The app shows the hub address and the carriers it accepts.
7.7 The buyer's address is shown to you only to ship that order, and it disappears from your view once the order is complete. Don't keep it, share it, or contact the buyer outside FoilFox.
8. Verified by FoilFox
8.1 When it applies. Verified is required, and included in the buyer's price, when any card in the order is $250 or more. Buyers can also choose it for cheaper cards, for a fee they pay.
8.2 What FoilFox checks. You ship the card to FoilFox's hub. We check that it's the right card (version, finish and language) with the FoilFox scanner, and a person checks that its condition matches your listing photos and the condition you chose. This is a check against your listing, not grading.
8.3 If the check passes, your money is released (section 2.4) and FoilFox sends the card on to the buyer. From then on, a problem the buyer reports with that card is FoilFox's to fix, and it isn't charged to you or counted as a strike. The exception is a counterfeit: if a card you sold turns out to be counterfeit, section 9.6 applies even after a passed check.
8.4 If the check fails:
- the order is cancelled and the buyer gets a full refund;
- the card comes back to you, and FoilFox pays the postage. The app asks you once for the address to send it to, which only FoilFox sees;
- it counts as a strike (section 12).
If the card is counterfeit, section 9.6 applies instead.
8.5 Who carries the risk. You do, until tracking shows the card delivered to the hub. FoilFox does while the card is in its care, until it's delivered to the buyer or back to you. If a card is lost or damaged while FoilFox has it, the buyer gets a full refund and you're paid as though the sale had completed.
9. Claims
9.1 What a buyer can claim (set reasons only):
- wrong card (version, finish or language);
- condition worse than listed;
- damaged in transit;
- missing card;
- counterfeit;
- not delivered (tracked orders only).
The time a buyer has to claim each one is set out in the Buyer Protection and Returns Policy.
9.2 Your response: within 2 business days. Choose one:
- accept a return (section 10);
- offer a partial refund of 10%, 20% or 30%, with the buyer keeping the card;
- disagree. Your listing and packing scans are attached for you.
If you don't respond in time, the buyer's claim is accepted and the refund in section 10 follows.
9.3 FoilFox decides. After you respond, a person at FoilFox decides the claim, usually within 3 business days of having everything needed. We look at the scans at listing, packing, the hub and arrival, both sides' photos, your answers to the buyer's questions, and tracking. A scan result on its own never decides a claim against you or the buyer. We take a partial-refund offer into account. Possible outcomes:
- release the money to you;
- a partial refund;
- a refund, with the card sent back to FoilFox (section 10);
- a refund, with the buyer keeping the card (section 10.4);
- the card sent to FoilFox for a closer look.
9.4 Asking us to look again. If you disagree with a decision, you can ask us once, through support@foilfoxtcg.com, to look at it again. Tell us why, and send anything we didn't have the first time, such as new photos or tracking.
9.5 Damage in transit is part of shipping, so a refund for it comes from your sale. You can make your own claim with the carrier (section 7.5).
9.6 Counterfeits.
- A card claimed as counterfeit comes to FoilFox's hub for a closer look.
- If it's genuine and as listed, we send it back to the buyer at our cost and your money is released.
- If it's counterfeit, the buyer gets a full refund, which comes from your sale. The card is not returned to you. We keep it for 90 days, in case you ask us to look again (section 9.4), or a rights owner or the police ask for it, and then destroy it. Your selling ends.
10. Returns
10.1 Returns go to FoilFox, never to you. When a claim is decided “refund with a return”, the buyer has 7 days to send the card to FoilFox's hub, with tracking. If they don't, the claim closes and your money is released.
10.2 When FoilFox receives the card:
- it's the card you sold: the buyer is refunded, and the card goes back to you at FoilFox's cost, to the address you give once in the app;
- it's a different card: FoilFox decides whether the buyer is refunded. If not, the claim closes and your money is released.
10.3 You pay the return postage. On a refund with a return, the buyer's refund includes a flat $7.50 toward their postage, and it comes from that order's money. It is never more than what's left of the order's total.
10.4 When the buyer keeps the card. The buyer is refunded and keeps the card, with nothing to send back, when:
- the card is under $10, or it came in a $1.50 untracked envelope order, because posting it back would cost more than makes sense. We may still ask for a card reported as counterfeit;
- a card was missing from the package;
- the package never arrived.
10.5 Returns for a change of mind aren't part of FoilFox's buyer protection, and FoilFox doesn't offer them.
11. Chargebacks
A buyer can still dispute a charge with their card issuer. FoilFox answers chargebacks with the order's evidence. If FoilFox loses one, we recover it from you only if a claim on the same facts would have been decided against you. Otherwise FoilFox bears the loss.
12. Seller levels, strikes and account actions
12.1 New sellers. Until you've made 10 sales and 30 days have passed since your first sale:
- each card can be up to $100;
- your open orders can total up to $250 of cards;
- money becomes payable 3 days after release.
After that, these limits lift.
12.2 Strikes. You get a strike for:
- a claim or return that ends in a refund to the buyer, in full or in part;
- an order cancelled because it wasn't shipped in time;
- shipping without a packing scan;
- a failed Verified check.
12.3 Three strikes within 90 days pause new sales. Your listings stay put but can't be bought, and orders already paid still ship and pay out. The pause lifts once fewer than three of your strikes fall within the last 90 days. Strikes are private: buyers never see them.
12.4 We may limit, pause or end your selling, or hold your payouts while we look into something, if:
- you break these terms;
- we reasonably suspect fraud, counterfeits or a risk to buyers;
- Stripe restricts your account;
- the INFORM Consumers Act requires it (section 14);
- the law requires it.
We tell you why, in the app or by email, and how to ask us to look again, unless the law or a fraud investigation stops us. Money we hold is paid out once the matter is settled, less amounts you owe under section 2.6.
12.5 If your selling ends, paid orders must still be shipped or will be refunded, and section 2.7 applies to your money.
12.6 You can stop selling at any time by removing your listings and finishing your open orders.
13. Talking to buyers
13.1 Messages on FoilFox are set questions, set replies and photos:
- buyers can ask about whitening on the back edges, scratches on the holo, creases or bends, or ask for a photo in daylight;
- you can answer “none seen”, “light”, “yes, see photo” or “photo added”, with your scan photos;
- you can tell a buyer you're running late.
There's no free-text chat, so phone numbers, emails and payment links can't be shared.
13.2 Keep sales on FoilFox. Don't invite a FoilFox buyer to buy, sell or trade outside FoilFox. Deals made off FoilFox have no protection, and moving a sale off FoilFox ends your selling.
13.3 The one exception is the contact details the law requires FoilFox to show for high-volume sellers (section 14.3). Use them only to answer questions about FoilFox orders.
14. High-volume sellers (INFORM Consumers Act)
14.1 Who counts. You're a high-volume seller if, in any 12 months in a row within the last 24, you made 200 or more sales and $5,000 or more in gross sales on FoilFox. FoilFox counts all your card sales toward this.
14.2 What we need. Within 10 days of reaching that level, you must give us, and we must verify:
- your bank account details;
- your taxpayer identification number;
- your name and contact details, including a working email address and phone number.
Most of this comes from your Stripe payout setup. At least once a year we ask you to confirm it's still correct, and you have 10 days to do so. If you don't provide or confirm it after we've told you and given you 10 days to respond, the law requires us to suspend your selling until you do.
14.3 $20,000 or more in a year. If your FoilFox sales reach $20,000 in a year, the law requires us to show buyers your name, your physical address and a working email address or phone number, in their order details after they buy. If you have no business address, only a home address, we show just your state and country. If your only phone number is a personal one, we show your email address only.
14.4 Reporting suspicious activity. High-volume sellers' listings show buyers how to report suspicious activity to FoilFox: in the app, by email at support@foilfoxtcg.com or by phone at (469) 305-2620.
15. Ratings
15.1 After an order's money is released, the buyer can rate you with 1 to 5 stars and set reasons: fast shipping, well packed and as described, or slow to ship, poor packing and not as described. There are no written reviews. Your average shows once you have 10 ratings; before that buyers see “New seller” and your number of sales.
15.2 Don't offer anything in return for a rating, or for changing one, and don't pressure a buyer about their rating. FoilFox doesn't remove honest ratings because they are negative.
16. Your information and photos
16.1 Buyers see your scan photos, your seller level, your number of sales, your rating once shown, and where you ship from (“Collector in Texas”, for example). They don't see your name, address or bank details, except where section 14.3 requires it. Buyers' card statements show FoilFox, not your name.
16.2 You allow FoilFox to show your listing scans and photos to buyers, and to use them, with your packing scans and answers, to run orders, check cards at the hub and decide claims. This permission continues for orders and claims that are still open after you remove a listing or close your account.
16.3 When you delete your FoilFox account, we delete your seller profile, your listings and their scans, and your strikes. Order records the buyer still needs stay, without your name, as the Privacy Policy describes. Stripe processes the information you give it under its own privacy policy.
17. Rights owners and reports
17.1 If you believe a listing infringes your copyright or trademark, or sells a counterfeit of your product, email support@foilfoxtcg.com with: the listing, the right you own, why the listing infringes it, your contact details, and a statement that you believe this in good faith and that your notice is accurate.
17.2 We remove or hide a listing that a proper notice identifies, and tell the seller. A seller who believes the notice is wrong can reply through support@foilfoxtcg.com with their reasons. We may restore the listing if the rights owner doesn't take the matter further.
17.3 We end the selling of anyone who repeatedly lists infringing or counterfeit items.
17.4 Anyone can report a listing, a seller or a buyer in the app or at support@foilfoxtcg.com.
18. Legal terms
18.1 You and your buyers. Each sale is between you and the buyer. FoilFox runs the marketplace, collects payment for you (section 2.2), decides claims under these terms, and answers for cards after a passed Verified check (section 8.3).
18.2 What FoilFox doesn't promise. The marketplace, the scanner and the catalog are provided as they are. FoilFox doesn't promise they'll always be available or error-free, or that a card will sell or at what price. Prices FoilFox shows are estimates, not offers.
18.3 Limit on FoilFox's liability. As far as the law allows:
- FoilFox isn't liable for indirect, incidental, special, consequential or punitive losses, or for lost profits or opportunities;
- FoilFox's total liability to you for all claims about the marketplace is the greater of $100 or the fees you paid FoilFox in the 12 months before the claim arose.
This limit doesn't reduce money FoilFox owes you under these terms (your released sale money, or payment for a card lost in FoilFox's care under section 8.5), or any liability the law doesn't allow to be limited.
18.4 Your responsibility. You'll cover FoilFox's losses and reasonable costs, including legal fees, from claims by others that arise because you sold a counterfeit or infringing card, broke these terms or the law, or didn't pay taxes you owe.
18.5 Disputes with FoilFox.
- Talk to us first. Email support@foilfoxtcg.com with what happened and what you'd like done. We'll try to settle it within 30 days, and neither of us starts a court case before then.
- Small claims. Either of us can take a claim to small claims court, including your local one, if the claim is within its limits.
- Courts. Otherwise, any dispute about the marketplace or these terms goes to the state or federal courts in Dallas County, Texas, and you and FoilFox agree to those courts' jurisdiction.
- Texas law governs these terms and any such dispute, without regard to conflict-of-law rules.
Nothing here takes away rights that the law where you live gives you and doesn't allow a contract to remove.
18.6 Changes to these terms. We tell you in the app and by email at least 30 days before a change that raises your costs or reduces your rights takes effect. Other changes, and changes the law or the safety of buyers requires, can apply sooner. A change never applies to an order already paid. If you don't agree to a change, you can stop selling before it takes effect.
18.7 Notices. We send notices in the app or to the email address on your account. You can send notices to support@foilfoxtcg.com or by post to Old Blue Chair LLC (FoilFox), PO Box 1332, Frisco, TX 75034.
18.8 The rest. If part of these terms can't be enforced, the rest still applies. If we don't enforce a term straight away, we can still enforce it later. You can't transfer these terms to anyone else; FoilFox can transfer them to a company that takes over the marketplace. These terms, the Buyer Protection and Returns Policy, the Terms of Service and the Privacy Policy are the whole agreement about selling on FoilFox.
